Malliotakis criticizes DA Bragg's plea deal for cop attacker

(NEW YORK, NY) - Congresswoman Nicole Malliotakis (NY-11) released a statement today regarding Manhattan District Attorney Alvin Bragg offering a plea deal to a teen migrant who assaulted two NYPD officers in Times Square.

"I strongly believe that Alvin Bragg intentionally handed Darwin Gomez-Izquiel, the illegal immigrant who assaulted a police officer and lieutenant in Times Square in January of this year, a 364-day sentence to prevent his deportation. This is a slap in the face to all New Yorkers, as under federal law, any illegal immigrant convicted of a crime punishable by a sentence of one year or more must be deported. A Class D violent felony such as this should have resulted in at least a two-year sentence. The judge should ensure that any plea deal includes deportation following the sentence being served. We must stay vigilant and continue to work with the New York City Police Benevolent Association and U.S. Immigration and Customs Enforcement to ensure he is deported after serving his sentence because Albany Democrats and left-wing prosecutors have gone out of their way to change laws and cut plea deals to protect illegal immigrants who commit crimes."

Malliotakis further stated: "Alvin Bragg’s intention is similar to when Governor Cuomo and Albany Democrats passed the One Day to Protect New Yorkers Act in 2019, which reduced the maximum sentence for class A misdemeanor offenses in New York State from one year to 364 days to protect illegal immigrants convicted of misdemeanor offenses."
