Congresswoman Nicole Malliotakis (NY-11) has introduced bipartisan legislation aimed at expanding the Working Families Tax Cut to eliminate federal taxes on overtime pay for all union workers. The bill is co-sponsored by Representatives Emilia Sykes (OH-13), Nick LaLota (NY-1), Steven Horsford (NV-4), Brian Fitzpatrick (PA-1), and Tom Suozzi (NY-3).
The proposed measure seeks to provide financial relief for union workers by removing federal taxes on their overtime earnings. Supporters argue that this would allow workers in various industries, including first responders, municipal employees, and building trades, to retain more of their income.
“I’m proud to join my colleagues in introducing this bipartisan legislation to expand no tax on overtime for all of America’s workers — including certain excluded first responders, municipal workers and union building trades who work and protect our communities,” said Rep. Nicole Malliotakis. “This bill honors the sacrifices of those who keep our neighborhoods safe and our economy strong, while ensuring hardworking Americans can keep more of what they earn. By lightening the tax burden on overtime pay, we’re rewarding the extra hours and hard work that so many families depend on.”
Rep. Emilia Sykes added: “American workers deserve a break. This bill will eliminate tax on overtime, giving people more breathing room and more money in their pockets. As a champion of working people, I’m proud to lead this bipartisan bill to ensure all workers get the benefit of no tax on overtime.”
Rep. Nick LaLota stated: “By expanding the no-tax-on-overtime provision to cover more firefighters, police officers, and other salt-of-the-earth Americans, we honor their long hours, heavy responsibilities, and the sacrifices they make for our communities. The Working Families Tax Cut is already delivering historic wins for hardworking Americans, and this latest step ensures these men and women can keep more of what they’ve rightfully earned to bring home to their families.”
Rep. Tom Suozzi commented: “This country runs thanks to rail workers, pilots, flight attendants, truck drivers, and ship captains and their crews. Our nurses, cops, and firefighters are the key to keeping us healthy and safe. It’s only fair that they’re all cut in on the deal to keep overtime hours from being taxed. These industries are crucial in sustaining our supply chain, protecting Americans, and getting us where they need to go, and the laborers make up the backbone of our middle class. They should not have been excluded to begin with. I’m pleased to join with my brothers and sisters in labor and my colleagues from both sides of the aisle to right this wrong. All workers, not just some, should be able to receive all their overtime tax-free.”
Rep. Brian Fitzpatrick said: “Hard work should never be punished. The No Tax on Overtime for All Workers Act is a bipartisan, pro-worker reform that makes qualified overtime pay fully deductible—because when working Americans give more of their time, they deserve more in their paycheck. Teamsters General President Sean M. O’Brien expressed support: “No taxes on overtime pay simply means that American workers can keep more of their hard-earned wages and better support their families,” he said. “Expanding this policy to cover more Americans and more Teamsters — including those in the trucking, rail, and aviation industries — is common sense. We commend Representatives Malliotakis, Sykes, LaLota, Suozzi, Fitzpatrick, and Horsford for their bipartisan leadership, and call on Congress to pass this bill.”

Nicole Malliotakis has represented New York’s 11th district since 2021 after serving ten years in the New York State Assembly.She was born in New York City in 1980,lives in Staten Island,and holds degrees from Seton Hall University as well as Wagner College.
